These Terms & Conditions (“Terms”) govern your use of italianvenetianplastersupply.com (the “Site”) and purchases from Italian Venetian Plaster Supply, operated by Du-All Microcement LLC, 311 SW 22nd Ave Unit #2, Miami, FL 33135 (“we”, “us”, “our”). By using the Site or placing an order, you agree to these Terms.
1. Products and information
Our products are professional decorative finishes manufactured in Italy by Di Donato SpA. We make every effort to display products, colors and technical information accurately; however, colors on screen and on printed samples may differ from the final applied finish, which depends on the substrate, the technique and the applicator. Technical information comes from the manufacturer’s Technical Data Sheets (TDS) and Safety Data Sheets (SDS), which prevail in case of discrepancy.
2. Prices and quotes
Prices are provided on request through our “Contact us” options. Quotes are valid for 30 days unless stated otherwise and may change with availability, exchange rates or manufacturer pricing. Prices are in U.S. dollars and exclude shipping and applicable sales tax unless stated. We may correct pricing or typographical errors at any time, including after an order is submitted.
3. Orders and payment
An order is accepted when we confirm it in writing and receive payment. We may refuse or cancel any order, for example in case of errors, suspected fraud or unavailability; if we cancel after payment, we will refund you in full. Accepted payment methods: credit cards, bank transfer/ACH, and checks for approved Trade accounts. Credit terms are available to Trade accounts only upon approval.
4. Shipping, risk and title
Shipping is governed by our Shipping page. Risk of loss passes to you when the products are delivered to you or to your carrier, or when picked up at our showroom. Title passes upon full payment. Hazardous materials (such as Liquid Metal Component B, UN 2289, Class 8) ship only by methods permitted by law.
5. Returns and refunds
Returns are governed by our Returns & Refunds policy. Tinted, custom and special-order products are not returnable.
6. Use and safety of products
Products are intended for use by, or under the guidance of, trained applicators. You are responsible for selecting suitable products, preparing substrates, following the manufacturer’s TDS and SDS, complying with local building codes and safety regulations, and testing the finish in a small area before full application. Keep products out of reach of children.
7. Warranty and disclaimer
Products are covered only by any warranty provided by the manufacturer (Di Donato SpA). To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We are not responsible for results caused by improper storage, substrate conditions, application technique or failure to follow the manufacturer’s instructions.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to the Site or a product is limited to the amount you paid for that product. We are not liable for indirect, incidental, special or consequential damages, including labor costs, loss of profits or delays.
9. Intellectual property
The Site content, including text, photos, logos and design, belongs to us or our licensors and may not be copied or used without permission. Product names and trademarks belong to their respective owners.
10. Accounts and Site use
You are responsible for keeping your account credentials confidential and for activity under your account. You agree not to misuse the Site, interfere with its operation or use it for unlawful purposes.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Miami-Dade County, Florida.
12. Changes
We may update these Terms at any time. The version posted on the Site at the time of your order applies to that order.
